Article 370 |Axioms Of Land

Due to political complexities, Jammu and Kashmir has been given a special status by the constitution of India. This provision has been made under Article 370.

J&K has a special constitutional status under the law of land. All the provisions of the constitution relating to states are not applicable to J&K, however, it is specified as a state under the same schedule. This situation is due to the fact that J&K acceded to the Union of India under extremely complicated situations. In lieu of Constitution of India, where state specific laws are required, state constitution is used.

Article 370 has been centre of a major political issue- Kashmir’s autonomy. A major political party BJP has been advocating scrapping of the law for two reasons: one: it was initially included as a temporary provision and two: State government may misuse the act if a pro-Pakistan government. However, in its regime, BJP hardly did anything in this regard.
